Compulsory civil liability insurance for private notaries
A notarial act gives a document legal force, and a notary's mistake can cost a client property or money. To guarantee that an injured party receives compensation, the legislation of Kazakhstan requires private notaries to insure their civil liability. Who must be insured
The obligation applies to all private notaries engaged in notarial activity. The contract is concluded for 12 months and is valid in the territory of the Republic of Kazakhstan. The policy should be renewed in advance so that the notary office never works without insurance protection.
By law, insurance agents are not allowed to conclude such contracts, and the contract itself is issued as an electronic policy. Therefore, the policy is arranged directly with the insurance company, while Insurance Center helps you choose one and prepare the documents.
What the policy covers

- property damage caused to a client or third parties in the course of notarial acts;
- damage caused by errors in certified documents, violations of the procedure for issuing them or loss of documents;
- compensation under a claim acknowledged with the insurer's consent or established by a court.
Typical limitations
- intentional infliction of harm;
- actions not related to notarial activity;
- events outside the term of the contract and the territory of Kazakhstan;
- the part of the loss within the deductible, if one is set.
Sum insured and rate
The minimum sum insured depends on where the notary works and is calculated in MCI as of the contract date. The parties agree on the premium, but the law caps its maximum amount. The law does not provide for a lower limit or correction factors.

A deductible is allowed by agreement of the parties, but not more than 5% of the sum insured. In the Insurance Center calculator you can choose not only the minimum sum but also higher limits — 2 000 MCI (8 650 000 ₸) or 5 000 MCI (21 625 000 ₸). This makes sense if the notary regularly certifies transactions involving expensive real estate or large assets.
Tip: the minimum sum covers only basic risks. If the value of the transactions you certify is well above the minimum limit, a single claim may exceed it, and you will have to cover the difference yourself.
Also bear in mind that the minimum is linked to the MCI as of the contract date: when you renew the policy in a new year, the amount in tenge may change and the old limit will no longer meet the legal requirement.
Why the policy matters for a notary's practice
A notary certifies real estate purchase and sale agreements, powers of attorney, wills, consents and other documents on which the rights of citizens and companies depend. An error in verifying the identity, legal capacity or authority of a party to a transaction may lead to the transaction being declared invalid and the injured party demanding compensation. Such claims are often comparable to the value of an apartment or a business.
An insurance policy makes compensation predictable: within the sum insured the payout is made by the insurer, and the notary does not risk personal funds. In addition, clients and partners feel more at ease with transactions when they know that the notary's liability is insured in accordance with the law. When choosing the limit, consider the typical value of transactions passing through your office and your annual workload.
What to check
- whether the area of activity is correctly defined and the minimum sum matches it;
- whether the amount in tenge is up to date given the MCI as of the contract date;
- whether there is a deductible and its amount;
- the start and end dates of the policy;
- the procedure and deadlines for notifying the insurer of a claim.

What to do in an insured event
- Once you receive a claim or notice of a lawsuit, inform the insurer immediately.
- Do not agree to a payment or admit fault without the insurance company's approval.
- Prepare copies of the notarial documents, extracts from the register and correspondence with the claimant.
- Provide the insurer with documents on the amount of the claimed damage.
- Wait for the insurer's decision and, if necessary, take part in court proceedings.
